1Introduction and scope

AI Funding Solutions (“AI Funding Solutions,” the “Company,” “we,” “us,” or “our”) is a software company organized as a Wyoming limited liability company, owned and powered by EazePay. We provide software that businesses install into their existing sales and marketing funnels to capture leads, pre-qualify them on real financial data, route them, and facilitate financing through third-party lenders at the point of sale.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information in connection with our websites (including ai-funding-solutions-production.up.railway.app and any successor or related domains), our software, applications, application programming interfaces, embedded forms, and any related services, content, and communications (collectively, the “Services”). It applies to information about prospective and current business customers and their personnel, website visitors, and consumers who interact with our pre-qualification tools through a business that uses our Services.

We are not a lender, broker-dealer, credit repair organization, or investment, financial, legal, or tax adviser, and we do not make credit decisions. We provide software and facilitate introductions to third-party lenders. Financing is offered, underwritten, approved, and funded solely by third-party lenders under their own terms and privacy practices.

By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, do not access or use the Services. This Privacy Policy is incorporated into and forms part of our Terms of Service.

2Our role: controller and processor

For information we collect about our own website visitors, prospective customers, and account holders, and for our own marketing, security, analytics, and product-improvement purposes, we act as a controller (or “business” under U.S. state privacy laws).

When a business installs our software and uses it to collect or process information about its own leads and consumers, that business is the controller of that information and we act as a service provider or processor that handles the information on the business’s behalf and under our agreement with that business. If you are a consumer who submitted information through a business that uses our Services, please direct privacy requests to that business in the first instance; we will support that business in responding as required by law.

3Eligibility; no use by children

The Services are intended for businesses and for individuals who are at least 18 years old. The Services are not directed to children, and we do not knowingly collect personal information from anyone under 18 years of age, and in no case from a child under 13 in violation of the Children’s Online Privacy Protection Act (COPPA). If you believe we have collected information from a child, contact us at admin@eazepay.com and we will delete it.

4Information we collect

Information you provide to us

  • Identifiers and contact details, such as your name, business name, work email address, telephone number, and mailing address.
  • Account and onboarding information, such as login credentials, role, and business details you provide when you request access, sign up, or are onboarded.
  • Commercial and transaction information, such as the plan you select, fees, and records of purchases or services.
  • Application and financial information that a consumer or business submits through our pre-qualification tools, which may include income, requested amount, employment, and similar data used to pre-qualify and route a lead.
  • Communications you send us, including messages, support requests, and survey or feedback responses.

Information we collect automatically

  • Device and technical data, such as IP address, browser type, operating system, device identifiers, and language settings.
  • Usage data, such as pages viewed, links clicked, referring and exit pages, session activity, and timestamps.
  • Cookies, web beacons, pixels, tags, and similar technologies as described in Section 9.

Information we receive from third parties

  • Soft-pull credit and risk information obtained from consumer reporting agencies and data providers, with consent and for a permissible purpose, as described in Section 5.
  • Information from third-party lenders, financing partners, and our affiliates (including EazePay) regarding application status, offers, and outcomes.
  • Information from service providers that support enrichment, identity verification, fraud prevention, analytics, and advertising.
  • Information from referral sources, partners, and publicly available or commercially available sources.

We may combine information from these sources. You are not required to provide personal information, but some features of the Services may not function without it.

5Soft-pull pre-qualification and the FCRA

Our pre-qualification tools may facilitate a “soft” credit inquiry (soft pull) through a consumer reporting agency or data provider, performed with the applicable consumer’s consent and for a permissible purpose under the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. A soft pull is used to estimate eligibility and does not affect the consumer’s credit score.

A “hard” credit inquiry, which may affect a credit score, occurs only at the lender’s full application stage and only with the consumer’s separate authorization to the lender. We are not a consumer reporting agency, we do not furnish or resell consumer reports, and we do not make credit or adverse-action decisions. Credit decisions, including any adverse-action notices required under the FCRA and the Equal Credit Opportunity Act (ECOA), are the responsibility of the lender or other decisioning party.

6How we use your information

We use personal information for the following purposes:

  • To provide, operate, maintain, and secure the Services, including installing the software, capturing and pre-qualifying leads, routing them, and facilitating introductions to third-party lenders.
  • To create and manage accounts, process fees and transactions, and provide customer support.
  • To communicate with you about the Services, including service, transactional, security, and administrative messages.
  • To personalize and improve the Services, conduct research and analytics, and develop new features.
  • To develop, test, train, tune, and evaluate our models, algorithms, and software, using de-identified or aggregated data where practicable, subject to the safeguards in Sections 8 and 12.
  • To detect, investigate, and prevent fraud, abuse, security incidents, and other unlawful or harmful activity.
  • To comply with legal obligations, enforce our agreements, establish, exercise, or defend legal claims, and respond to lawful requests.
  • For marketing and promotional purposes, where permitted and subject to your choices and applicable law (see Sections 10 and 14).

7Automated processing and artificial intelligence

The Services use automated tools, models, and software agents to capture, score, pre-qualify, and route leads and to surface potential financing options. These tools are facilitative: they help estimate eligibility and route a lead, and they do not constitute a final credit decision, which rests solely with the third-party lender or decisioning party.

Our models are designed not to use protected-class characteristics as inputs. Automated outputs may be incomplete or inaccurate and should not be relied upon as financial, legal, or eligibility advice. Where required by applicable law, you may have the right to request information about, or to object to, certain automated processing; see Section 14 and contact us at admin@eazepay.com.

8How we disclose your information

We disclose personal information in the following circumstances:

  • Third-party lenders and financing partners, to facilitate pre-qualification, offers, and funding that a consumer or business has requested.
  • Service providers and processors that perform services on our behalf, such as cloud hosting, data storage, payment processing, identity verification, fraud prevention, analytics, communications, and customer support, including EazePay, each bound by contractual confidentiality and data-protection obligations.
  • Affiliates within the EazePay corporate family, for the purposes described in this Privacy Policy.
  • Professional advisers, such as lawyers, auditors, and insurers, where reasonably necessary.
  • Government, regulatory, or law-enforcement authorities, or other parties, where we believe disclosure is required by law, legal process, or to protect rights, property, or safety.
  • Acquirers or successors in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets, subject to customary protections.
  • Other parties with your consent or at your direction.
  • In aggregated or de-identified form that cannot reasonably be used to identify you.

9We do not sell your personal information

We do not sell your personal information for money, and we do not knowingly “sell” or “share” personal information of consumers we know to be under 16 years of age, as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA/CPRA”), and similar state laws.

Certain uses of cookies and similar technologies for analytics and advertising may be considered a “sale” or “sharing” for cross-context behavioral advertising under some state laws. You may opt out of these activities at any time by emailing admin@eazepay.com with the subject “Do Not Sell or Share,” by using available browser privacy controls and Global Privacy Control (GPC) signals, which we honor where required, and by adjusting cookie controls as described in Section 9 of this policy. If we materially change our practices, we will update this section.

10Cookies and tracking technologies

We and our service providers use cookies, web beacons, pixels, tags, local storage, and similar technologies to operate and secure the Services, remember preferences, measure performance, understand usage, and support analytics and advertising. Some are strictly necessary for the Services to function; others are optional.

You can control cookies through your browser settings, by deleting or blocking cookies, and through opt-out tools offered by analytics and advertising providers. Some browsers offer a “Do Not Track” signal; because there is no common industry standard, we respond to legally recognized opt-out preference signals such as Global Privacy Control where required by law. Disabling some cookies may affect how the Services function.

11Marketing communications and the TCPA

With your consent where required, we may contact you by email, telephone, or text message (SMS/MMS) about the Services. Where you provide a telephone number and the required prior express written consent, you agree that we and parties acting on our behalf may contact you using automatic telephone dialing systems, artificial or prerecorded voice messages, and text messages, consistent with the Telephone Consumer Protection Act (TCPA) and applicable law. Consent is not a condition of purchase. Message and data rates may apply, and message frequency varies.

You may opt out of marketing emails using the unsubscribe link in any such email, opt out of text messages by replying STOP (and reply HELP for help), or contact us at admin@eazepay.com. We may still send you non-marketing service, transactional, security, and administrative messages.

12Financial privacy and the GLBA

Where we handle nonpublic personal financial information in connection with a financial product or service, we treat that information consistent with the Gramm-Leach-Bliley Act (GLBA) and its implementing rules, including the Safeguards Rule. We maintain an information-security program with administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of such information, and we limit access and disclosure of that information to what is reasonably necessary to provide the Services and as permitted by law.

13Data security

We implement administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest where appropriate, access controls, least-privilege practices, and monitoring. We segregate and encrypt sensitive financial information and limit who can access it.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your account credentials and for any activity under your account. If you believe your account or information has been compromised, contact us immediately at admin@eazepay.com.

14Data retention

We retain personal information for as long as necessary to provide the Services, maintain business and financial records, comply with our legal, regulatory, tax, accounting, and recordkeeping obligations, resolve disputes, prevent fraud, and enforce our agreements. Retention periods depend on the nature of the information and the purpose for which it is processed; for example, certain financing and compliance records may be retained for multi-year statutory periods. When information is no longer needed, we delete, de-identify, or anonymize it in a manner consistent with applicable law.

15Your privacy rights and how to exercise them

Depending on where you live and subject to applicable law, you may have some or all of the following rights regarding personal information we control:

  • To know or access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of recipients.
  • To request correction of inaccurate personal information.
  • To request deletion of personal information, subject to legal exceptions.
  • To opt out of the “sale” or “sharing” of personal information and of targeted or cross-context behavioral advertising.
  • To limit the use and disclosure of sensitive personal information where applicable.
  • To data portability, where applicable.
  • To not receive discriminatory treatment for exercising your rights.
  • To withdraw consent where processing is based on consent, and to opt out of marketing.

Residents of California, Virginia, Colorado, Connecticut, Utah, and other states with comprehensive privacy laws may exercise the rights provided by their state’s law. California’s “Shine the Light” law (Cal. Civ. Code § 1798.83) permits California residents to request information about disclosures to third parties for their direct-marketing purposes; we do not share personal information with third parties for those parties’ own direct-marketing purposes.

To exercise a right, email admin@eazepay.com with the subject “Privacy Request” and describe your request. We will verify your identity before responding and will respond within the timeframes required by applicable law. You may use an authorized agent to submit a request on your behalf with proof of authorization. If we decline a request, you may appeal by replying to our response; we will inform you of the outcome and of any further options, including contacting your state attorney general.

16U.S. processing and international users

The Services are operated in the United States and are intended for users in the United States. If you access the Services from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where data-protection laws may differ from those of your jurisdiction, and you consent to that transfer and processing.

17Third-party links and services

The Services may link to or integrate with third-party websites, lenders, and services that we do not control. This Privacy Policy does not apply to those third parties, and we are not responsible for their content, practices, or privacy policies. We encourage you to review the privacy policies of any third party, including any lender, before providing information.

18Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version on this page and revise the “Last updated” date above, and, where required by law, provide additional notice. Your continued use of the Services after the updated Privacy Policy becomes effective constitutes your acceptance of the changes. Please review this page periodically.
